9. Governing law
These terms are governed by the laws of the Republic of Türkiye.
Consumers keep their rights under mandatory law, including the right to apply to the competent consumer arbitration committees and courts.
Part 2: Yacht Charter Booking Conditions
1. Scope and priority of the contract
This part gives a general summary of our booking conditions. It does not replace your written offer or the Yacht Charter Agreement.
Every charter is subject to the terms of the Yacht Charter Agreement you sign. If the information on this website differs from the signed agreement, the signed agreement prevails, without prejudice to mandatory consumer rights.
2. Enquiries, options and booking confirmation
An enquiry or request for a quotation does not mean that a yacht is automatically reserved.
On your written request and with the owner’s approval, an option may be placed on the yacht for specific dates. An option is valid until the deadline notified in writing and may lapse without further notice if the booking is not confirmed within that time.
A booking is confirmed only when:
- the Yacht Charter Agreement has been signed by the required parties; and
- the first payment specified in the agreement has reached our account.
The agreement normally has to be signed within five days of the date of issue, or within the notified option period. The payment plan and currency are set out in your offer and agreement.
So that menus, dietary preferences, transfers and other arrangements can be planned, a Client Preferences List is normally requested about two weeks before embarkation.
3. Charter period
A large share of weekly charters start on a Saturday and end on the following Saturday. Depending on the yacht and season, other start days and shorter or longer charter periods may also be offered.
Unless the agreement states otherwise, embarkation is normally from 17:00 and disembarkation is by 10:00 after breakfast on the final day.
Exact dates, times and ports are stated in your offer and in the Yacht Charter Agreement.
4. What the charter fee includes
Unless your offer states otherwise, the charter fee generally includes:
- exclusive use of the yacht and its guest accommodation;
- the professional yacht crew;
- yacht insurance;
- bed linen and towels;
- fresh water for normal use on board;
- fuel and lubricants for a standard weekly itinerary of up to approximately 100–110 nautical miles in Turkish waters;
- Turkish transit log formalities and public harbour fees specified in your offer; and
- use of the standard equipment in the yacht’s inventory.
Air-conditioning hours, water toys and other facilities vary from yacht to yacht. The applicable information is given on the yacht page, in your offer or in the Yacht Charter Agreement.
5. What the charter fee does not include
Unless your offer expressly states that they are included, the following are not part of the charter fee:
- VAT;
- Full Board, Half Board or other meal packages;
- soft drinks, drinking water and alcoholic beverages;
- fuel for motorised water sports;
- private marina fees;
- mooring buoy and mooring line fees;
- national park, local authority and protected-area charges;
- airport transfers and land excursions;
- personal expenses;
- crew gratuities; and
- personal travel, health, accident and cancellation insurance.
Costs of international itineraries, including to the Greek islands, are payable separately. These may include port and marina fees, local taxes, entry and exit formalities, transit logs, agency services, additional fuel and other official charges.
If an APA or similar expense advance applies, this will be stated clearly in your offer and agreement.
Provided this is confirmed in advance, guests can generally bring their own drinks on board without paying a service charge. Catering arrangements and meal packages may vary according to the yacht, the route and the booking conditions.
Crew gratuities are not compulsory and should reflect your satisfaction with the service. Approximately 10–15% of the charter fee is a general guideline and may be given directly to the captain to be shared among the crew.
6. Itinerary and cruising conditions
Your preferred itinerary is planned together before the charter. All itineraries, however, remain subject to weather and sea conditions, port availability, official restrictions, the characteristics of the yacht and the captain’s professional judgement.
We cannot guarantee a specific island, bay or harbour that cannot safely, lawfully or operationally be visited.
International itineraries require additional official formalities. If entry conditions, regulations or local operating conditions prevent the planned voyage, the itinerary may be changed.
7. The captain’s authority
The captain is responsible for the safe navigation, operation and security of the yacht.
The charterer and all guests must follow the captain’s reasonable instructions on navigation, weather, anchorages, swimming, water toys, safety and conduct on board. The captain may change the route or restrict a particular activity for safety or legal reasons.
8. Guests’ responsibilities
The yacht may be used only for the private holiday purpose stated in the Yacht Charter Agreement.
The charterer is responsible for:
- ensuring that the number of guests does not exceed the yacht’s licensed capacity;
- guests complying with the law and the yacht’s safety rules;
- ensuring that passports, visas, travel and any required health documents are valid;
- children being supervised by a responsible adult;
- notifying relevant medical conditions, allergies and dietary needs in advance; and
- taking proper care of the yacht and its equipment.
The charter may not be transferred or sublet to another person without prior written approval.
Illegal drugs, unauthorised weapons or unlawful activities may lead to the charter being terminated without refund, without prejudice to applicable law.
Pets are accepted only with the prior written approval of the yacht owner or operator and the captain.
9. Payments
Payments must be made in line with the amounts, dates, currency and payment method stated in the offer and the Yacht Charter Agreement.
Late payment may lead to the option or booking being cancelled in accordance with the agreement.
Bank charges, exchange-rate differences or card processing fees apply as stated in the offer or payment instructions.
10. Cancellation by the charterer
Cancellation requests must be made in writing.
Unless the signed Yacht Charter Agreement states otherwise, the following cancellation charges apply to the total charter fee:
| Time before embarkation date | Cancellation charge |
|---|---|
| 16 weeks or more | 30% |
| 10–15 weeks | 40% |
| 5–9 weeks | 50% |
| 4 weeks or less | 100% |
Payments already made are set against the cancellation charge. If the payments received are less than the applicable charge, the difference may have to be paid.
If the yacht is re-chartered for the same period, any refund or reduction that may apply is calculated under the Yacht Charter Agreement after commissions, discounts and reasonable costs have been deducted.
Postponing a booking to another season or year is not an automatic right; it requires the written approval of Gulet Point and the yacht owner.
11. Non-delivery, alternative yacht and technical breakdowns
If the yacht named in the agreement cannot be delivered, Gulet Point and the yacht owner will make reasonable efforts to offer a suitable, comparable alternative yacht.
If no suitable solution can be offered, the guest’s rights to cancel, to a refund or otherwise are determined under the Yacht Charter Agreement and applicable mandatory law.
If a technical problem arises during the charter, the captain, the yacht owner and the operations team must be given a reasonable opportunity to investigate and resolve it. Depending on the circumstances, solutions such as repair, an alternative yacht, a change of route, an extension of the charter if the yacht is available, or a proportionate refund may be considered.
The exact periods and remedies that apply to your booking are stated in the signed Yacht Charter Agreement.
12. Force majeure and events beyond our control
Weather conditions, official restrictions, closure of borders or ports, natural events, epidemics, civil events and other circumstances beyond the reasonable control of the parties may affect the charter or the itinerary.
In such cases the parties’ rights and obligations are determined under the Yacht Charter Agreement and applicable law.
13. Insurance and activities on board
The yacht is insured under the insurance terms that apply to its commercial operation. Yacht insurance does not replace guests’ personal travel, health, accident, liability or cancellation insurance.
Guests should take part in swimming, snorkelling, water sports and other activities in line with the captain’s safety instructions and within their own experience and state of health.
We strongly recommend that all guests arrange comprehensive travel, health, accident and cancellation insurance before travelling.
Nothing in this part removes a liability that cannot lawfully be limited.
14. Complaints and notices
Any problem arising during the charter should be reported immediately to the captain and to Gulet Point, so that it can be investigated and, where possible, resolved while the voyage continues.
If the problem cannot be resolved on board, a written complaint, with the relevant information and supporting documents, should be sent to Gulet Point within seven days of leaving the yacht.
This notice procedure does not limit the guest’s rights under mandatory law.
15. Entire agreement
The written offer, the signed Yacht Charter Agreement and any written, approved amendments together form the contract that applies to the charter.
The booking conditions on this website are provided to give clear information in advance and should be read together with the documents prepared for each yacht and booking.
